This was the largest jury verdict in Cobb County in 2010.

In May of 2012, Nelson Tyrone and co-counsel Lloyd Bell obtained a 5.4 Million Dollar jury verdict on behalf of a husband who developed CRPS after a technician injured a nerve near his elbow with a needle during a blood draw. In that case, the wife recovered 2 Million Dollars for the loss of services, affection and support (called “loss of consortium” under the law) of her spouse. This was the largest verdict of its kind in Georgia history.

Here is a basic overview of this horrible, debilitating disorder:

RSD/ CRPS is a terrible, debilitating and life-changing condition. There are few treatments, and the treatment goals are often to slow the spread of the disease rather than to stop it; it cannot be eradicated by any means. Reflex Sympathetic Dystrophy (RSD or RSDS) is also known as Complex Regional Pain Syndrome (CRPS). It is a chronic pain syndrome and is noted for its symptoms of:

  • severe burning pain
  • extreme sensitivity to touch
  • swelling
  • excessive sweating
  • tissue discoloration.

RSD/ CRPS can be best diagnosed with the following specific criteria recognized by the International Association for the Study of Pain (IASP):

CRPS-1 (Reflex Sympathetic Dystrophy)

  1. The presence of an initiating noxious event, or a cause of immobilization.
  2. Continuing pain, allodynia, or hyperalgesia with which the pain is disproportionate to any inciting event.
  3. Evidence at some time of edema, changes in skin blood flow, or abnormal sudomotor activity in the region of the pain.
  4. This diagnosis is excluded by the existence of conditions that would otherwise account for the degree of pain and dysfunction.

Note: Criteria 2-4 must be satisfied.

CRPS-2 (Causalgia)

  1. The presence of continuing pain, allodynia, or hyperalgesia after a nerve injury, not necessarily limited to the distribution of the injured nerve.
  2. Evidence at some time of edema, changes in skin blood flow, or abnormal sudomotor activity in the region of the pain.
  3. This diagnosis is excluded by the existence of conditions that would otherwise account for the degree of pain and dysfunction.

Note: All three criteria must be satisfied.

Causes of CRPS

CRPS and RSD can often be traced back to an accident or injury that results in nerve damage of some kind. This accident or injury can also be the result of mistakes made during surgery. The injury generally happens to a hand, forearm, foot, ankle or calf.

Sometimes the patient cannot recall the accident or injury that triggered the RSD/ CRPS.

When the onset of RSD/ CRPS can be traced back to an inciting event- an accident, a burn, a surgery or a fall, and if the injury was the result of another’s negligence or intentional act, the RSD/ CRPS victim may be entitled to compensatory damages. The claim must be made within the time limit permitted by law to successfully collect against the negligent person or party.
